SHAH ALAM: Pindaan beberapa seksyen dalam Enakmen Pentadbiran Agama Islam (negeri Selangor) 2003 (Enakmen 2003 ) yang diluluskan sidang Dewan Undangan Negeri (Dun) pada 11 Julai lalu sudah mendapat perkenan Sultan Selangor, Sultan Sharafuddin Idris Shah.
Pengerusi Majlis Agama Islam Selangor (Mais), Datuk Mohamad Adzib Mohd Isa berkata, sehubungan itu, pihaknya bersedia memberi taklimat kepada Ahli Dewan Undangan Negeri (Adun) di negeri itu bagi mengelak timbulnya salah faham atau kekeliruan.
“Saya boleh beri penerangan kalau ada pihak yang mahu tahu mengenai Undang-Undang Enakmen Pentadbiran Agama Islam (Negeri Selangor) pindaan 2011 Rang Undang-Undang (RUU Pindaan) yang membuat pindaan ke atas beberapa peruntukan seksyen dalam Enakmen Pentadbiran Agama Islam (Negeri Selangor) 2003 (Enakmen 2003).
“Ingin saya jelaskan semua urusan termasuk pelantikan, pentadbiran dan pengurusan institusi itu yang turut membabitkan Jabatan Agama Islam (Jais) dan Lembaga Zakat Selangor (LZS) mendapat titah serta perkenan Duli Yang Maha Mulia (DYMM) Tuanku,” katanya pada sidang akhbar, di sini, semalam.
Beliau berkata demikian bagi menjelaskan laporan sebuah laman portal bertajuk
‘Mais now has free hand over zakat’.
Artikel berkenaan antara lain menyiarkan komen Adun berhubung Rang Undang-Undang Enakmen Pentadbiran Agama Islam (Negeri Selangor) pindaan 2011 (RUU Pindaan) yang membuat pindaan ke atas beberapa peruntukan seksyen dalam Enakmen Pentadbiran Agama Islam (Negeri Selangor) 2003 (Enakmen 2003).
Mohamad Adzib berkata, antara perkara dibangkitkan dalam pindaan yang diluluskan DUN dan diwartakan pada 25 Ogos lalu itu termasuk mengenai pelantikan Setiausaha Mais dan pengagihan wang zakat di Selangor.

MAIS now has free hand over zakat’s millions
The July amendments to a state law has allegedly removed Selangor's Islamic Religious Council (MAIS) accountability to the state government.
PETALING JAYA: It’s a bitter pill to swallow for many Selangor assemblymen now that the government may have lost control over the state’s Islamic administrative matters and the estimated tens of millions of ringgit in annual zakat collections.
The amendments made in July seemingly allowed the state’s Islamic Religious Council (MAIS) to be accountable only to the Sultan of Selangor, Sultan Sharafudin Idris Shah, bypassing the state government in the process.
The amendments affected the Administration of the Religion of Islam (State of Selangor) Enactment 2003.
Previously, Section 16 of the Enactment – which was passed at the July State Legislative Assembly sitting – enabled the director of Selangor’s Islamic Religious Department (JAIS) to be appointed as MAIS’s secretary.
The secretary would also act as the council’s chief executive officer and administrator, and was responsible for carrying out MAIS’s policies and resolutions.
However, the July amendments took that detail out, and allowed the Ruler “on advice of the Majlis” (MAIS) to appoint the council’s secretary.
Speaking under condition of anonymity, a state assemblyman said that the change allowed MAIS to snub summonses from the State Legislative Assembly’s committee.
“In one occasion, MAIS was summoned by a House committee overseeing statutory bodies and subsidiaries. They refused to appear on the grounds that they were not subject to the committee,” he told FMT.
Zakat money
The assemblyman added that MAIS was a statutory body created by the Enactment, and had financial autonomy in its affairs.
“They still have to table their audited accounts before the House… They can appoint their own auditors… But they are not duty-bound to come before the committee.”
“The effect of this, politically, is a government within a government, and Islamic affairs are taken out of the control of the state government,” he said.
This was of special concern, the assemblyman added, given that the amendments also gave MAIS the power to collect and distribute zakat as well as fitrah.
Selangor zakat money, he said, came up to about a third of the state government’s annual revenue which was roughly RM1.4 billion.
With this in tow, MAIS, according to an anonymous Pakatan Rakyat leader, could do whatever it wished with its companies without worrying about the state assembly looking over its shoulder.
“At the policy and state level, MAIS has six or seven government-linked companies under it… They said that the (state) government has no shared interest in MAIS’ corporations.
“So they tried to twist this (to their advantage), by saying that the administration (of MAIS) is under the Sultan… If we raised our voice (against it), they will raise the issue of derhaka (betrayal),” the leader said.
Royal appointments
FMT previously reported that Selangor state assemblymen allegedly received a letter from the Sultan at the July 11 state assembly sitting, commanding them to agree to these amendments.
Caught by surprise and fearing a constitutional crisis in the event of a refusal, Pakatan state assemblymen allowed the amendments to be passed without a hitch.
Currently, the Sultan has the power to appoint the MAIS chairman, deputy chairman and “not fewer than eight other members” to the council.
MAIS also consists of five ex-officio (automatic) members – the state secretary, state legal adviser, state financial officer, the mufti and the chief police officer.
According to the anonymous state assemblyman, the building and administration of mosques and suraus were also affected by the amendments.
JAIS, as well as the state government, he claimed, would have to spend money to build them, while the administration of these buildings would fall under MAIS’ purview.
“Now, to build a mosque or a surau, you have to get approval from MAIS… Construction of the mosque is under JAIS, but the management is under MAIS,” he said.
Another interesting development was the deletion of Section 85 of the Enactment.
Provisions of the Statutory Bodies Act (Accounts and Annual Reports) Act 1980 now no longer apply to MAIS.
No need for audit
According to Malaysian Centre for Constitutionalism and Human Rights lawyer K Shanmuga, this meant that MAIS did not have to submit its accounts to the Auditor-General.
“The effect of the amendment is that the accounts of MAIS (and any other statutory corporation established by MAIS under the Enactment) will no longer have to be audited in accordance with the Audit Act 1957 and submitted to the Auditor-General each year.”
“In fact, there appears to be no provisions in the Administration of the Religion of Islam Enactment requiring any audit,” he said.
A script read by the proposer of the amendments passed at the July 11 state assembly sitting was also provided to FMT.
In regards to Section 85, it read: “This section was abolished because the council is not included in the definition of ‘Statutory Body’ in regard to the Statutory Bodies (Accounts and Annual Reports) Act 1980 [Act 240].”

Selangor upset over ‘royal’ intervention
In July, the Sultan of Selangor ordered assemblymen to pass amendments giving him more power over Islamic affairs.
PETALING JAYA: Selangor state assemblymen are seeing red with what appears to be royal intervention in the running of the State Legislative Assembly.
In July, every state assemblyman allegedy received a letter from Sultan Sharafudin Idris Shah, commanding them to agree to amendments that would supposedly give the Ruler more power over Islamic affairs.
Pakatan Rakyat state assemblymen suspect that the hand of Umno was behind the move, which they say could have led to a constitutional crisis.
One, who spoke under condition of anonymity, said they saw the letter on their desks at about 9:30am when they attended the July 11 state assembly sitting.
The letter was accompanied by a Selangor government gazette with proposed amendments to the Administration of the Religion of Islam (State of Selangor) Enactment 2003.
“We did not know what to do,” the assemblyman told FMT. “We were totally shocked. It was a very delicate situation. If we went against it, it would have caused a constitutional crisis.
“The Sultan is supposed to act on the advice of the state government, not the other way around. Even in the matters of Islam and Malay culture, the Sultan has to act on the advice of the state administration.
“We didn’t want to fight the palace, we had respect for the palace. We let it pass.”
He added that if the assembly had snubbed the letter and voted against the proposed amendments, it would have been played to the hilt by both the mainstream media and the Umno-led state opposition.
Sultan’s letter
A copy of the letter was given to FMT by an anonymous sender. It was issued from the Alam Shah palace in Klang on July 11 and has the Sultan’s signature on it.
“As the head of Islam in the state, I am responsible for ensuring that the administration of Islam in the state operates smoothly and effectively,” the letter reads (see below).
“Therefore, I command all Yang Berhormat Members (of the Selangor State Assembly) to agree with the proposed amendments presented and approve the Bill so that these proposed amendments can be implemented immediately.”
A letter from the Sultan’s private secretary, Mohamed Munir Bani, to state assembly secretary Mohamad Yasin Bidin was also provided to FMT.
It reads: “I respectfully present the decree of His Majesty the Sultan of Selangor… to be distributed to all Selangor State Assemblymen immediately.”
The proposed amendments would:
- Make the administration of all mosques and suraus fall under the purview of the Selangor Islamic Religious Council (MAIS).
- This responsibility was previously held by the director of Selangor Islamic Religious Department (JAIS).
- Give the Sultan the right to directly appoint anyone to the post of MAIS secretary.
- Remove the need to record in verbatim every resolution and policy made during MAIS meetings.
- Require all practising Syariah lawyers in the state to be Muslim.
- Require cheques issued by MAIS to be drawn according to its own financial procedures.
- Remove the need for MAIS and any corporation established under the Enactment to adhere to provisions in the Statutory Bodies (Accounts and Annual Reports) Act 1980.
- Give MAIS the power not only to collect zakat and tithes, but also to distribute it.
- Give MAIS the power to appoint anyone as mosque officials.
- Give MAIS the right to control and direct the duties of mosque committees.
There were 22 clauses stated in the provided gazette, with amendments to 21 sections within the Enactment.
Phone call from palace
Another assemblyman, who also spoke to FMT anonymously, said that the proposed amendments were initially made available at a state pre-council meeting, a “few days” before July 11.
According to him, many state assemblymen present at the meeting were unhappy with the bill and hotly debated the details.
“They voiced their displeasure at the bill,” he said. “They felt they should have been consulted first because of its importance.”
Menteri Besar Khalid Ibrahim, according to the assemblyman, said he was troubled by the introduction of the amendments.
“The MB requested that the bill be kept in abeyance pending further study.”
The Selangor mufti, state legal adviser and aides to the various assemblymen were also at the meeting, according to the assemblymen.
“The MB asked the officers to leave and the assemblymen to stay to discuss the bill.”
Halfway through the discussion, the assemblyman said, Khalid had to step out to take a call from the palace. Apparently, the displeasure of the state assemblymen had been conveyed to the palace.
“The MB did not make it clear what the palace had said, but the assemblymen took the cue, and understanding his (Khalid) predicament, did not pursue the postponement of the bill.”
According to the assemblyman, the Sultan exceeded his powers when he ordered assemblymen to pass the amendments. Nevertheless, the bill was passed after three readings.
One of FMT’s sources said he expects to see royal influence expand to “unknown arms at this juncture”.
Umno, he said, was “definitely” behind the letter from the palace. He claimed that MAIS was staffed by “a number of Umno or pro-Umno people.”
Umno’s hand
A Pakatan Rakyat leader, who asked to remain anonymous, also said he suspected that Umno had pushed the palace.
“The Sultan has been advised by Umno for 50 years,” he said. “This put His Majesty in a very difficult situation.
“This was a ploy by Umno to put Pakatan at loggerheads with the Sultan.”
He defended the Sultan as an “objective” person, but said Mohamad Munir, being pro-Umno, had made it difficult for Khalid to get an audience.
Sungai Panjang state assemblyman Mohamed Khir Toyo claimed ignorance of the matter, while Seri Serdang assemblyman and state opposition leader Mohamad Satim Diman could not be contacted.
Semenyih state assemblyman Johan Aziz scoffed at Pakatan’s claim that Umno was behind the Sultan’s letter.
“Everything is about Umno, even floods, although it’s from God,” he said. “It’s all Umno, Umno, Umno. All the good things that Umno does, they never talk about.”
However, Johan declined to comment on the Selangor government’s alleged loss of power through this episode.

RUU Pindaan tersebut telah diluluskan oleh Dewan Negeri pada 11 Julai 2011 dan telah diwartakan pada 25 Ogos 2011 setelah mendapat perkenan DYMM Sultan Selangor.
Kenyataan media ini dibuat oleh MAIS untuk menjawab komen-komen yang disiarkan dalam artikel tersebut bagi mengelakkan orang ramai mempunyai tanggapan salah terhadap tujuan pindaan dibuat.
Pelantikan Setiausaha MAIS oleh DYMM Sultan
Pindaan ke atas peruntukan seksyen 16(1) Enakmen 2003 bertujuan memberi kuasa kepada DYMM Sultan, atas nasihat MAIS, untuk melantik mana-mana orang sebagai Setiausaha MAIS. Sebelum daripada pindaan, Pengarah Jabatan Agama Islam Selangor (JAIS) akan secara automatik menjawat jawatan Setiausaha MAIS.
Pindaan tersebut dibuat setelah mengambilkira faktor beban tugas dan tanggungjawab sedia ada Pengarah JAIS sebagai Ketua jabatan berkenaan yang mempunyai pertambahan tugas dan tanggungjawab apabila menjadi Setiausaha MAIS pada masa yang sama. Pengarah JAIS mempunyai tanggungjawab yang berat dalam mengawalselia kira-kira 2,676 kakitangan yang bertugas di lapan (8) bahagian di ibu pejabat dan sepuluh (10) pejabat cawangan di daerah-daerah seluruh negeri Selangor. Ini tidak termasuk seramai lebih 8,000 guru KAFA dan kakitangan yang bertugas di sekolah-sekolah agama, Rendah dan Menengah di seluruh negeri Selangor.
Pelantikan mana-mana orang selain Pengarah JAIS sebagai Setiausaha MAIS akan membantu melancarkan lagi perjalanan pentadbiran MAIS yang antara lain perlu menguruskan pentadbiran lebih kurang 400 buah masjid dan hampir 1,900 buah surau di seluruh negeri Selangor.
MAIS bertanggungjawab kepada DYMM Sultan Selangor
Walaupun MAIS merupakan satu badan berkanun kerana ditubuhkan melalui peruntukan undang-undang seksyen 4(1) Enakmen 2003, tetapi berbeza dengan badan berkanun lain yang ditubuhkan di bawah mana-mana Enakmen Negeri, penubuhan MAIS adalah atas kehendak DYMM Sultan Selangor selaras dengan peruntukan Fasal (1) Perkara XLVIII Undang-Undang Tubuh Selangor 1959 (UTK 1959).
Selaras dengan peruntukan UTK 1959 yang sama, penubuhan MAIS adalah bagi maksud membantu dan menasihati DYMM Sultan dalam semua perkara yang berhubungan dengan agama Islam. Dalam erti kata lain, MAIS bertanggungjawab sepenuhnya kepada DYMM Sultan Selangor yang merupakan Ketua Agama Islam bagi negeri Selangor dan oleh itu tidak tertakluk kepada bidang kuasa Jawatankuasa Dewan Negeri.
Wang Zakat
Pindaan ke atas seksyen 86 Enakmen 2003 untuk memasukkan perkataan “... dan mengagih ...” adalah bagi maksud menjelaskan lagi fungsi Majlis dalam pengurusan wang zakat dan fitrah yang bukan sahaja bertanggungjawab untuk membuat pungutan tetapi juga bertanggungjawab mengagihkan wang zakat dan fitrah di negeri Selangor.
Pindaan seksyen tersebut juga bertujuan bagi mengelakkan sebarang kekeliruan yang timbul disebabkan penggubalan Enakmen 2003 yang telah meninggalkan perkataan “mengagihkan” sedangkan dalam undang-undang terdahulu iaitu Undang-undang Pentadbiran Agama Islam Negeri Selangor 1952 telah memperuntukkan kuasa kepada MAIS untuk memungut dan membahagikan wang zakat dan fitrah menurut Hukum Syarak.
Selanjutnya, wang zakat dan fitrah tidak termasuk sebagai wang yang dipertanggungkan dalam Kumpulan Wang Yang Disatukan di bawah Fasal (3) Perkara LXXXVI UTK 1959. Ini adalah kerana wang zakat dan fitrah adalah merupakan wang yang berasingan dengan wang hasil Kerajaan Negeri yang perlu disalurkan ke dalam Kumpulan Wang Yang Disatukan.
Pembayaran wang zakat dan fitrah adalah merupakan kewajipan semua orang yang beragama Islam dan akan dimasukkan ke dalam Baitulmal yang ditubuhkan di bawah peruntukan seksyen 81(1) Enakmen 2003. Wang zakat dan fitrah tersebut kemudiannya akan diagihkan mengikut asnaf yang dibenarkan oleh agama Islam dan semua jumlah kutipan perlu disalurkan kepada asnaf yang berkenaan dan perlu diagih sepenuhnya dalam tahun semasa. Oleh kerana itu, pengagihan wang zakat dan fitrah perlulah dijalankan oleh MAIS.
MAIS tidak menubuhkan syarikat yang mempunyai kaitan dengan Kerajaan atau pun GLC. Walau bagaimanapun MAIS telah menubuhkan beberapa anak syarikat di antaranya Lembaga Zakat Selangor (LZS), Kolej Universiti Islam Antarabangsa Selangor (KUIS), Kumpulan MAIS Corporation dan Perbadanan Wakaf Selangor (PWS). Penubuhan anak syarikat ini adalah selaras dengan peruntukan seksyen 8 dan 9 Enakmen 2003 bagi membantu MAIS menjalankan kewajipannya di bawah seksyen 7 Enakmen 2003 iaitu bagi mendorong, menggalak dan membangunkan kesejahteraan sosial dan ekonomi orang Islam di negeri Selangor.
Penggunaan wang zakat oleh MAIS atau anak syarikatnya adalah terkawal. Sebarang cadangan penggunaan wang zakat hendaklah melepasi pertimbangan jawatankuasa-jawatankuasa tertentu termasuklah Jawatankuasa Fatwa Negeri Selangor sekiranya timbul persoalan berhubung kesahan penggunaan wang zakat menurut Hukum Syarak.
Titah DYMM Sultan
Berhubung titah DYMM Sultan Selangor kepada Ahli Dewan Negeri semasa RUU Pindaan dibentangkan di Dewan Negeri, titah tersebut dibuat selaras dengan kedudukan DYMM Sultan Selangor sebagai Ketua Agama Islam di bawah Perkara XLVIII UTK 1959. DYMM Sultan juga merupakan sebahagian dari Dewan Negeri di bawah Perkara LXI UTK 1959 dan boleh mengutuskan titah kepada Dewan Negeri di bawah Perkara LXXIII.
Melalui titah yang diutuskan ke Dewan Negeri, DYMM Sultan telah memaklumkan Ahli Dewan Negeri bahawa DYMM Sultan, setelah meneliti RUU Pindaan tersebut dan setelah mendengar nasihat MAIS, telah berpuas hati bahawa semua cadangan pindaan sekiranya diluluskan dapat memberikan kebaikan kepada pentadbiran Agama Islam dan juga semua rakyat yang beragama Islam.
Titah DYMM Sultan tersebut dibuat bertujuan untuk melancarkan lagi perjalanan Dewan Negeri dan bagi membolehkan Ahli Dewan Negeri menumpukan lebih masa dan perhatian kepada perkara yang lebih relevan dengan pentadbiran Kerajaan Negeri dan hal ehwal kebajikan rakyat di negeri Selangor.
Pentadbiran masjid dan surau di bawah MAIS
Bukan semua masjid dan surau dibina menggunakan peruntukan kewangan Kerajaan Negeri. Hanya dalam hal keadaan di mana pembinaan dibuat di atas tanah Negeri, peruntukan kewangan diperolehi dari Kerajaan Negeri. Ini adalah selari dengan tanggungjawab sosial Kerajaan Negeri untuk mengeluarkan peruntukan kewangan bagi pembangunan agama Islam yang merupakan Agama Negeri.
Masjid yang siap dibina kemudiannya diletakkan di bawah pentadbiran MAIS dan MAIS selanjutnya akan mentadbir dan menyelenggarakan masjid tersebut menggunakan peruntukan dari Baitulmal. Keadaan ini sebenarnya membantu meringankan beban kewangan Kerajaan Negeri yang tidak lagi perlu mengeluarkan peruntukan kewangan bagi maksud yang sama.
Pengauditan akaun MAIS
Dakwaan yang mengatakan bahawa Laporan Kewangan Tahunan MAIS tidak perlu lagi diaudit oleh Ketua Audit Negara adalah tidak tepat sama sekali. Pemansuhan seksyen 85 Enakmen bukanlah dibuat tanpa asas yang kukuh. Laporan Kewangan Tahunan MAIS Disatukan telah disediakan dan dikemukakan kepada Ketua Audit Negara setiap tahun dan MAIS selama 14 tahun iaitu dari tahun 1997 sehingga tahun 2010 telah pun mendapat pengiktirafan sijil bersih melalui Sijil Ketua Audit Negara. Laporan yang sama juga telah dikeluarkan oleh MAIS untuk rujukan awam dan salinan boleh diperolehi melalui laman sesawang MAIS.
Begitu juga bagi kumpulan wang zakat yang telah diaudit oleh pihak Audit Negara bermula 1997 sehingga kini melibatkan pengurusan kutipan dan agihan zakat. Manakala bagi akaun pengurusan amil, Lembaga Zakat Selangor (LZS) juga telah diaudit oleh pihak juruaudit luar bermula dari awal penubuhannya pada tahun 1996. Di samping itu, bagi menambah nilai kualiti pengurusan LZS, pihak Price Waterhouse Coopers (PwC) telah melaksanakan audit penilaian strategik LZS pada tahun 2009.
Sebagai tambahan, bagi memperkasakan keupayaan audit dalam LZS, pihak KPMG telah diberi kepercayaan untuk melatih dan memperbaiki fungsi pengauditan dalaman.
Kesimpulan
MAIS bersedia mengadakan sesi taklimat kepada mana-mana Ahli Dewan Negeri yang ingin mendapatkan maklumat lanjut mengenai institusi MAIS supaya sebarang kekeliruan dan salah faham dapat dielakkan.
Untuk makluman semua, Ahlli MAIS terdiri dari pihak yang pakar dalam bidang pentadbiran, ekonomi, perakaunan, undang-undang Syariah dan juga undang-undang sivil. MAIS juga telah menubuhkan 24 jawatankuasa tetap untuk membantu menjalankan fungsi MAIS. Di samping itu MAIS juga telah menubuhkan Jawatankuasa Fatwa Negeri Selangor bagi membincangkan apa-apa persoalan berhubung dengan Hukum Syarak.
